In the same way, Articles 227 and 228 of the Code of Criminal Procedures support the right to abstain from speaking against one's family members.
وبالطريقة ذاتها يؤيد قانون الإجراءات الجنائية، في مادتيه 227 و 228، الامتناععنالشهادة ضد أفراد الأسرة.
However, such an order cannot be given to persons who are permitted by law to refuse to testify.
بيد أنه لا يجوز إصدار هذا الأمر في حق الأشخاص الذين يسمح لهم القانون بالامتناععن الإدلاء بالشهادة.
“(c) Other objects and documents, including the results of examinations or diagnostic tests related to the health of the accused, to which, by their nature, the right not to testify applies.
“(ج) الأشياء أو الوثائق الأخرى، بما فيها نتائج الفحوص والتشخيصات الطبية للمتهم، والتي يشملها بطبيعة الحال الحق في الامتناععن الإدلاء بالشهادة.
“(b) Notes that persons mentioned in item (a) above may have taken down about communications from the accused or about any circumstance regarding which they have the right to refuse to testify; and
“(ب) الملاحظات التي قد يدونها الأشخاص المشار إليهم في الفقرة (أ) أعلاه، بشأن رسائل من المتهم، أو بخصوص أي ظرف من الظروف التي يشملها الحق في الامتناععن الإدلاء بالشهادة،
(2) The investigating judge shall, in the same way, order the destruction without delay of any official reports or other objects, as referred to in paragraph 1, if they relate to statements made by or to a person who would be able to decline to give evidence, pursuant to section 218, if he were asked as a witness to disclose the content of the statements.
(2) ويقوم قاضي التحقيق، بنفس الطريقة، بإصدار أمر بالقيام دون تأخير بإتلاف أي تقارير رسمية أو أشياء أخرى، على النحو المشار إليه في الفقرة 1، إذا كانت تتعلق ببيانات أدلى بها شخص يحق لـه الامتناععن تقديم الشهادة عملاً بالمادة 218، إذا طُلب إليه كشاهد الكشف عن مضمون تلك البيانات، أو إذا كانت هذه البيانات موجهة إلى ذلك الشخص.
